EL ABOGADO LOCAL JOSÉ ANTONIO MARTÍNEZ, PRESENTARÁ ESTE MIÉRCOLES UN LIBRO QUE TRATA LOS DELITOS URBANÍSTICOS

La Sala Sevilla de la Casa de la Cultura de Arahal será este miércoles 27 de Abril, a las 20.00 horas, testigo y escenario de la presentación del primer libro del abogado arahalense, José Antonio Martínez Rodríguez, titulado "Delitos Urbanísticos en la Doctrina y la Jurisprudencia Españolas". El acto contará con la presencia del alcalde de Arahal, Miguel Ángel Márquez y del también letrado arahalense, Manuel Fernández Fuentes, que se encargará de presentar a la obra y a su autor.
El libro a presentar trata un asunto de mucha actualidad y especial interés en nuestro municipio y, por supuesto, en el resto del territorio español. Su prologuista, el Dr. Juan Antonio Martos Núñez, Profesor Titular de Derecho Penal de la Universidad de Sevilla, lo define así:
"Los delitos relativos a la ordenación del territorio y el urbanismo", constituyen tipos penales de notable complejidad técnica y de sobresaliente importancia social y política. En efecto, son frecuentes las condenas judiciales a propietarios de viviendas edificadas en suelos no urbanizables, con penas privativas de libertad, multa y la orden de demolición de la obra ilegalmente construida. Estas sentencias judiciales suponen la prueba más evidente de lo que se ha denominado "la batalla judicial contra el urbanismo salvaje". La responsabilidad de esta situación corresponde, en buena medida, a la actitud condescendiente, cuando no cómplice, de los Ayuntamientos que, en base a un desarrollo económico rápido, pero insostenible e irrespetuoso con la Naturaleza, llevó a muchos Alcaldes a permitir parcelaciones y edificaciones ilegales en sus bosques de encinas y alcornoques o en el litoral marítimo-terrestre, con la esperanza de que el argumento de los hechos consumados sería bastante para regularizar -que no desmantelar estas urbanizaciones ilegales-, lo que nació sin un solo papel. Con el tiempo, el recorrido ha sido el inverso y algunos de estos Alcaldes y propietarios han acabado ante el Juez, condenados e inhabilitados de sus cargos públicos o profesiones, por la comisión de estos delitos.
Este es el trasfondo criminológico y sociopolítico del Trabajo de Investigación que el Licenciado D. JOSÉ ANTONIO MARTÍNEZ RODRÍGUEZ, ha realizado, bajo mi dirección científica, con el título: DELITOS URBANISTICOS EN LA DOCTRINA Y JURISPRUDENCIA ESPAÑOLAS, que tengo el honor de prologar. El lector tiene en sus manos una investigación académica, exhaustiva y rigurosa sobre EL DELITO URBANÍSTICO, que aborda los tipos penales, tanto desde la óptica de la moderna Dogmática penal, como desde el prisma, más concreto y casuístico, de la Jurisprudencia Constitucional, la Doctrina del Tribunal Supremo y las Sentencias de las Audiencias Provinciales. La técnica de redacción de este trabajo ha sido muy elaborada, pese a la complejidad de la materia, y su lectura, pues, resulta amena, comprensible y muy recomendable, tanto para estudiantes como para los profesionales del Derecho Público. Acertadas conclusiones ponen el broche de oro a un brillante trabajo de Investigación jurídicopenal, que se cierra con un práctico Anexo Legislativo sobre las Normativa vigente en materia de Urbanismo y Ordenación del Territorio, tanto de Derecho Comunitario como de Derecho estatal y autonómico".
José Antonio Martínez Rodríguez, nació en Arahal (Sevilla), el 7 de diciembre de 1963, Licenciado en Derecho por la Universidad Nacional del Educación a Distancia (UNED), Letrado ejerciente del Ilustre Colegio de Abogados de Sevilla, Diplomado en Estudios Avanzados por el Departamento de Derecho Penal y Procesal de la Universidad de Sevilla, con una calificación de Sobresaliente por unanimidad del Tribunal, Master Superior en Prevención de Riesgos Laborales, Diploma en Derecho Tributario y Asesoría Fiscal, y Diploma en Gestión Laboral y Seguridad Social por el Centro de Estudios Técnicos Empresariales, diploma en Derecho Urbanístico y Medio Ambiente, Diploma en Derecho Penitenciario, por el Ilustre Colegio de Abogados de Sevilla; encontrándose actualmente elaborando la Tesis Doctoral en materia de Derecho Penal y Procesal en la Universidad de Sevilla y continuando su trabajo diario en el consistorio arahalense.

José Antonio Martínez Rodríguez, born in Arahal (Sevilla), 7 December 1963, Law degree from the Universidad Nacional de Educación a Distancia (UNED), a practicing Lawyer of the Bar Association of Seville, Diploma in Advanced Studies at the Department of Criminal Law and Procedure at the University of Sevilla, with a rating of Excellent Court unanimously, Master Degree in Occupational Health and Safety, Diploma in Tax Law and Tax Advisory and Management Diploma in Labor and Social Security Center Business Technical Studies, Diploma in Urban and Environmental Law, Diploma in Prison Law, the Bar Association of Seville, he has now developed the doctoral thesis on Criminal Law and Procedure at the University of Seville.
PROLOGUE
"Crimes relating to land use and urban planning," constitute crimes of significant technical complexity and outstanding social and political importance. In fact, there are frequent convictions homeowners built on undeveloped land, with imprisonment, fine and demolition order for the work illegally built. These judgments represent the clearest evidence of what has been called "the legal battle against the urban wild." The responsibility for this situation corresponds to a large extent, the condescending attitude, if not complicit, in the municipalities that, based on rapid economic growth, but unsustainable and disrespectful nature led many mayors to allow subdivisions and buildings illegal in the forests of oaks on the coast or sea-land, with the hope that the argument of the facts would be enough to stabilize-not dismantle these illegal developments, "he was born without a single paper. Over time, the route has been reversed and some of these mayors and owners have ended before a court, convicted and banned from public office or profession, for committing these crimes.
This is the criminological and socio-political background of the research work that the lawyer D. JOSÉ ANTONIO RODRÍGUEZ MARTÍNEZ, made under my scientific management, with the title: URBAN CRIME IN THE DOCTRINE AND JURISPRUDENCE SPANISH, I have the honor to prologue. The reader is holding an academic research, thorough and rigorous URBAN CRIME, which addresses the criminal, both from the standpoint of modern criminal dogmatics as the prism, more concrete and casuistic, the Constitutional Court, the Supreme Court doctrine and the judgments of the provincial courts. The technique of writing of this work has been made, despite the complexity of the matter, and reading, then, is entertaining, understandable and highly recommended for both students and practitioners of public law. Sound conclusions put the finishing touches on a brilliant job jurídicopenal Research, which closes with a practical Legislative Annex on existing legislation on Urban and Regional Planning, both of Community law as state and regional law.
